INSTRUCTIONS FOR WAIVER OF PENALTY AND INTEREST

According to Sec. 33.011 of the State Property Tax Code, "The governing body" (Commissioners Court) "of a taxing unit shall waive penalties and may provide for the waiver of interest on a delinquent tax if an act or omission of an officer, employee, or agent of the taxing unit or the appraisal district in which the taxing unit participates caused or resulted in the taxpayer’s failure to pay the tax before delinquency and if the tax is paid within 21 days after the taxpayer knows or should know of the delinquency. A request for waiver of penalties under this section must be made within six months of the delinquency date." (Effective August 26, 1991) The Fort Bend County Tax Office is governed by the laws set forth by the legislators of the State of Texas - only policies and procedures are set by this office which adhere to these laws. The procedures the taxpayer must follow are:

  1. The account must be paid in full (includes penalty and interest and attorney fees) within 21 days of knowing of the delinquency.
  2. In writing, request to be placed on Commissioners Court agenda to present their case. Account number, legal description, year(s) in question and your current mailing address and phone number must be included on your request.
  3. Mail request to:

  4. The Judge’s office will notify you of when you are scheduled to appear before Commissioners Court.
  5. It is up to the taxpayer to show substantial proof that an error was made by the tax office or the Central Appraisal District and that penalty and interest should be waived.
  6. The tax office, upon completion of researching the account in question, will mail you a copy of the findings as submitted to Commissioners Court.
  7. If Commissioners Court waives the penalty and interest a refund will be issued.
